The end of the PHE: What home health & hospice providers need to know

Read the latest white paper from Sharon Harder, President and CEO, C3 Advisors, LLC, where she covers the most pressing waiver issues and other legislative provisions that were issued during the PHE, and how providers can remain compliant after May 11, 2023.

The public health emergency (PHE), first declared in early 2020, expired on May 11, 2023. While the declaration of the PHE and the implementation of § 1135 waivers of certain requirements caused much confusion among providers, the end of the PHE is raising even more questions. And now, the need for guidance is more necessary than ever, given subsequent CMS actions to extend some of the waivers as well as new legislation affecting operations.

Download the white paper to learn more about:

  • Permanent federal legislation and accompanying regulations that have no expiration date
  • The § 1135 waivers addressed by subsequent legislation that temporarily extend the waived rule
  • The temporary § 1135 waivers that ended with the end of the PHE
  • The § 1135 waiver topic that was made permanent based on CMS rulemaking
  • The HHS directive that has now expired

“The public health emergency created many new challenges for home health and hospice providers. As CMS attempted to alleviate some of these challenges by issuing waivers (at the same time that Congress was also addressing legislative changes), things started to get confusing. We’ve laid out what has changed and what providers need to be thinking about in the weeks and months to come as we revert from the PHE back to a more normalized approach of conducting business and serving patients. The PHE is over. Welcome back to yet another “new normal”.”
