The recent Access Rule proposed by the Centers for Medicare & Medicaid Services (CMS) could bring significant changes to your Medicaid waiver program. The proposed rule applies to all Medicaid services, including home and community-based services (HCBS) that are vital to people with disabilities as well as older adults.

  • Spend 80% of specific Medicaid payments to compensate direct care workers

  • Conduct person-centered planning reassessments annually
  • Maintain an incident management system
  • Establish a grievance process for people receiving HCBS
  • Track HCBS quality measures

Rachel Neely, LMSW (She/Her)
Director of LTSS Policy, ADvancing States

Rachel Neely is the Director of LTSS Policy for ADvancing States. In this role, she leads policy and regulatory analyses related to Medicaid LTSS and HCBS, provides technical assistance and consulting to state Medicaid agencies, and supports states projects and initiatives. Before joining ADvancing States, Ms. Neely worked for over five years at the Texas Health and Human Services Commission, where she served as a Senior Policy Advisor. She served as policy lead for the state’s self-direction option, subject matter expert for 1915(k) Community First Choice policy, and project lead for implementation of the HCBS Settings Rule. Ms. Neely holds a bachelor’s degree in English from the College of William & Mary and master’s degree in Social Work, with a concentration in administration and policy practice, from the University of Texas at Austin.

Senior Director of Special Initiatives and Partnerships, SAGE

Sherrill serves as a trusted thought partner to national initiatives team members and SAGE staff across the organization. They lead the National Resource Center on LGBTQ Aging, serves as SAGE lead for the Long-Term Care Equality Index (in partnership with the Human Rights Campaign Foundation) and works in close partnership with SAGECollab, SAGECare, and the Diverse Elders Coalition. Sherrill began work with SAGE at the local level in 2008, founding the SAGE Affiliate in St. Louis, MO (now Missourians Aging with Pride). Sherrill earned a Master of Social Work degree from the Brown School of Social Work, Washington University in St. Louis, and has over 25 years of professional experience in the fields of education, disability, and LGBTQ+ older adult advocacy.
