Simplifying price transparency regulations: Everything specialty care hospitals need to know

On January 1, 2021, new regulations went into effect that required most hospitals in the United States to make their standard and negotiated prices available to the public. In April, members of Congress wrote to HSS encouraging stricter enforcement and oversight of this regulation. Hospitals now face a significant legal challenge as failure to comply with this new regulation can result in enforcement actions.

While enforcement ramps up, hospital providers are still struggling to understand most areas of the regulation including required standards for data, the types of “shoppable” services covered by the rule, and more.

In this webinar, experienced healthcare lawyers Thomas Barker and Ross Margulies, Partners in Foley Hoag LLP’s healthcare practice, will break down the rule, helping specialty care hospital providers understand what must be done to ensure compliance.

Ross Margulies | Partner, Foley Hoag LLP

An experienced healthcare attorney, Ross brings a proactive approach to client management, helping providers, payers, manufacturers, and other innovators navigate federal and state healthcare regulatory. Ross has a special expertise in Medicare and Medicaid law, including coverage, reimbursement, and regulatory oversight. He represents his clients before the United States Congress and the Centers for Medicare & Medicaid Services (CMS) and other components of the Department of Health and Human Services (HHS), the Department of Labor, and the Internal Revenue Service. Prior to joining Foley Hoag, Ross served as a Research Associate at the George Washington University Milken Institute School of Public Health where he focused on healthcare legal issues involving the Medicare and Medicaid programs. He has also worked in a variety of public sector settings, including serving in the Office of the General Counsel (OGC) at the U.S. Department of Health and Human Services and at the Health Resources & Services Administration (HRSA).

Thomas Barker | Partner, Foley Hoag LLP

Thomas Barker has been a partner at Foley Hoag since March of 2009. Tom focuses his practice on complex federal and state health care legal and regulatory matters with a special expertise in Medicare and Medicaid law including coverage, reimbursement, and regulatory oversight. Since arriving at Foley Hoag, Tom has represented health care providers and payers. He represents his clients before the United States Congress and the Centers for Medicare & Medicaid Services (CMS) and other components of the Department of Health and Human Services (HHS), the Department of Labor, and the Internal Revenue Service. Prior to coming to Foley Hoag, Tom served in a succession of high-level federal health care policy positions throughout the Administration of President George W. Bush. In 2008, he served as acting General Counsel of HHS; from 2005 – 2008, he served as health policy advisor under HHS Secretary Michael Leavitt. While serving as acting General Counsel, Tom oversaw a staff of some 450 attorneys responsible for attesting to the legal sufficiency of every regulation and interpretive guidance published by the Department. In that role, he provided legal advice to Secretary Leavitt, along with the Administrator of CMS and Commissioner of the Food and Drug Administration.
